Seller Agreement
Version seller-2026-08-24 · Working business template for attorney review before launch.
Your promises as a seller
You confirm that you are at least 18, the information you provide is accurate, you have the legal right to sell every item, and each listing and photograph is your own or lawfully used. You will not list counterfeit, stolen, recalled, hazardous, illegal, infringing, or payment-processor-prohibited goods.
Listing review
Every third-party listing is pending until approved by The Gettin Place. Approval does not guarantee authenticity, legality, quality, sale, or payment. We may request additional photographs, proof of purchase, authentication, measurements, or corrections before or after approval.
Descriptions and photographs
You must accurately describe the brand, model, condition, measurements, alterations, missing pieces, authenticity status, and all known damage or flaws. Photographs must show the actual item. The main photo must clearly represent the product. AI suggestions are only drafting assistance and must be checked by the seller.
Orders, shipping, and buyer information
You must ship only to the approved order address, within the stated handling time, using tracking. Buyer information may be used only to fulfill that order and may not be copied, marketed to, sold, or disclosed for another purpose.
Payments and delayed seller transfers
Buyer payments are processed through Stripe. The platform may create a separate transfer of the seller's net proceeds after tracked delivery and the applicable review period. This is delayed payout administration, not escrow. Payment timing may be affected by processing, reserves, disputes, refunds, chargebacks, verification, or law.
Auction timing and commitments
Sellers choose the closing date and time for each auction. The platform's recorded time controls when bidding closes. After an auction receives a bid, a seller may not shorten its duration, cancel it, or materially change the item without administrator approval. Approved active auctions from all sellers may be displayed in order of the soonest closing time.
Fees, taxes, refunds, and losses
There is no fee to create or submit a listing. For a completed third-party Buy Now sale, The Gettin Place deducts a 10% seller commission from the item price before transferring the seller's proceeds. The 18% auction buyer's premium is charged to the winning bidder, not deducted as a listing fee. Any other seller charge must be clearly disclosed before the seller agrees to it. Sellers remain responsible for their own income and business taxes. Marketplace sales tax may be collected by the platform where required. If a refund, chargeback, counterfeit claim, shipping loss, or materially inaccurate listing is attributable to the seller, amounts may be withheld or recovered as allowed by law and processor rules.
License and termination
You grant The Gettin Place a nonexclusive license to display and promote submitted listing content for marketplace purposes. Either party may end the seller relationship, but duties connected to existing orders, claims, fees, taxes, and records survive.
Electronic acceptance
Checking the agreement box and submitting an item records your email, agreement version, date and time, and device information as evidence of electronic acceptance.
